User (Service Requester) Agreement
1. Introduction
1.1. This User Agreement ("Agreement") is made between Healtius Teknoloji Anonim Şirketi ("Company"), registered with the Ankara Trade Registry and located at Universiteler Mah. 1596 Cad. 6. AR-GE C Block Building No:6C Office No:11 06800 Ankara/Türkiye, and the User as defined below. It governs the terms and conditions for using the services and related facilities provided via the platforms determined by the Company (Healtius platform), including its web and mobile applications, in the capacity of a Member and Service Requester ("User").
2. Definitions
2.1. Unless otherwise clearly understood from the context, the following expressions in this agreement shall be interpreted as defined below:
Service Requester: Persons who have agreed with the Service Provider regarding the service and whose consultation request has been approved by the Service Provider.
Service Provider: Persons who access the Healtius platform in accordance with the User Agreement and start using the application with the intention of providing services by completing membership procedures in accordance with the Service Provider Agreement.
Request: Request created for health services offered by service providers on the Healtius platform.
Offer: Offers created by Service Providers for requests created by users on the Healtius platform.
Institution / Organization / Doctor: Institution, Organization, Doctor, or Physician defined on the Healtius platform who will make an offer to the user and have an online consultation with the user.
Online Payment System: System that provides collection of the fee determined by the relevant health institution or organization through third-party software within the Healtius platform.
Online Consultation Service: Online appointment service received through the Healtius platform or by the relevant health institution or organization directing the user to the application.
Application: Healtius web and mobile application.
Content Provider: Real or legal persons who produce, modify and provide any information or data provided through the internet environment within the scope of the Internet Law.
Internet Law: Law No. 5651 on Regulation of Publications Made on the Internet and Combating Crimes Committed Through These Publications.
User: Persons who use the Healtius platform in various ways as members and/or service requesters.
Working Hours: Time period between 09:00 and 17:00 on Monday, Tuesday, Wednesday, Thursday and Friday.
Platform: Healtius web and mobile application.
Member: Persons who create an account by filling out the membership form and completing the necessary procedures on the Healtius platform, who can receive offers from Service Providers and send consultation requests.
Hosting Provider: Real or legal persons who provide or operate systems that host services and content within the scope of the Internet Law.
3. Purpose
3.1. The purpose of this Agreement is to regulate the mutual rights and obligations of the parties regarding the provision of Online Consultation Services registered in the Application and provided to Users by the relevant Healthcare Institution or Organization through the Healtius platform managed by Healtius Teknoloji Anonim Şirketi, as well as other matters set forth in this Agreement.
3.2. The Healtius platform is a platform where:
The Service Provider can log in to their account, create a profile for their healthcare services, submit offers to requests, and communicate with users by scheduling appointments.
The Service Requester can receive offers for healthcare services upon request, evaluate offers, communicate, access non-diagnostic advice and estimated treatment costs published by doctors via the Healtius platform, and conduct audio and/or video consultations for a fee determined by the relevant healthcare institution, organization, or physician.
4. General Terms
4.1. This Agreement applies to the User as defined above.
4.2. This Agreement becomes effective from the moment the User registers with the Healtius platform. Users must read this Agreement before performing any transaction on the platform.
4.3. If the User does not accept some or all of the terms set out in the Agreement, they may not carry out any transactions on the Healtius platform. By conducting transactions on the Healtius platform, the User is deemed to have accepted and approved the terms outlined in this Agreement.
4.4. Any changes, updates, or adjustments made by the Company to the application are within the scope of this Agreement. By approving this Agreement, the User accepts that such changes are at the sole discretion of Healtius Teknoloji Anonim Şirketi. Additional approval will be obtained from the User for changes made to their detriment.
4.5. If this Agreement is modified, the updated agreement will be published in the application and on the website www.healtius.com. If the updated agreement is not accepted by the User, access to the application will be immediately terminated, and personal data will be destroyed using methods specified in relevant legislation and guidelines during periodic data destruction periods.
5. User Rights and Obligations
5.1. The User declares, acknowledges, and undertakes that the personal information provided during registration on the Healtius platform is accurate, the contact details such as phone number and email address are up to date, and that the relevant healthcare institution, organization, or doctor providing the service may contact them using this information. The User accepts that the Company shall not be held responsible for any failed appointments or service processes arising from incorrect or incomplete information. The Company will send a verification email to confirm the User's email address.
5.2. The User declares and undertakes that they are over the age of 18 and acknowledge the requirement to be at least 18 years old to use the Healtius platform.
5.3. Under this Agreement, the User agrees not to reproduce, distribute, or copy any content within the application in a way that infringes upon the rights of the Company or any third parties.
5.4. The User acknowledges that only one account per real individual is allowed on the Healtius platform, and they may not use another person's account. If the User wants to register on behalf of someone for whom they are a guardian, they must inform Healtius Teknoloji Anonim Şirketi and provide the requested signed documentation.
5.5. The User may choose to allow or deny the application to send instant notification messages.
5.6. The User may submit a request regarding services via the platform, receive offers from service providers, and send a consultation request to a Service Provider based on the Service Provider's availability.
5.7. If the User forgets their password, they may request a password reset link to be sent to the email address provided during account creation.
5.8. The User acknowledges that the comments or feedback they provide about services received through the Healtius platform represent their own opinion, do not bind the Company, and the Company shall not be held liable for any damages arising from such comments or feedback. The Company reserves the right to share these with healthcare institutions, organizations, or doctors and to remove or hide them at its discretion.
5.9. The User agrees not to engage in any malicious activity that may compromise the integrity or performance of the Healtius platform.
5.10. The User agrees not to share their username and password with anyone, and any actions performed using their credentials shall be considered performed by the User.
5.11. The User acknowledges that Healtius Teknoloji Anonim Şirketi has no obligation to monitor the content of communications made through the application and that it cannot interfere with the operation of the applications of healthcare institutions, organizations, and/or doctors. 5.12. The User agrees to attend the online consultation punctually, have a stable internet connection and functional camera, be in a quiet and private space to ensure patient confidentiality, and ensure no third parties are present during the consultation.
5.13. The User acknowledges that the Online Consultation Service is encrypted end-to-end to ensure data privacy and that Healtius does not record the video consultation. Messages and documents shared via the application's messaging feature may be stored on the Company's servers and shared with the relevant healthcare provider or doctor.
5.14. The User declares that the credit card or other payment tools used in the Online Payment System belong to them, and they will not use another person's card without explicit consent. The Company is not responsible for verifying compliance with this obligation.
5.15. The User agrees not to engage in immoral or inappropriate behavior towards doctors during consultations. In case of misconduct, the doctor may terminate the session without issuing a refund. The Company is not responsible for proving such behavior due to the lack of session recording.
5.16. If the User terminates the consultation for a valid reason, they must inform the relevant healthcare institution, organization, or doctor. Whether the reason is valid will be determined by the provider, who may reschedule at their discretion. If not accepted as valid, the User waives any right to reschedule or receive a refund.
5.17. If the consultation is canceled by the Service Provider, the User shall receive a full refund.
5.18. Users may cancel appointments up to 48 hours before the scheduled time without a fee. Cancellations within 48 hours are subject to a 25% fee. No-shows without notice will be handled per clause 5.19.
5.19. If a User fails to attend or rejects the call without valid justification, the Service Provider is entitled to the consultation fee.
5.20. Technical failures not caused by the Service Requester must be reported to the Company.
5.21. The consultation will start via a link sent as a notification at the appointment time.
5.22. The User agrees to act in accordance with this Agreement and the distance sales contract.
5.23. By approving this Agreement, the User consents to receive informational emails from the Company.
5.24. The User agrees that the Company may alter or discontinue services or content at any time.
5.25. This Agreement may be terminated by deleting the account. Any scheduled appointments after account deletion will not be refunded.
6. Company Rights and Obligations
6.1. The Company will use its best efforts to provide timely, secure, and quality service via the Healtius platform but offers no guarantees.
6.2. The Company agrees to comply with obligations under the Internet Law and the Personal Data Protection Law.
6.3. The Company is responsible for invoicing and delivering receipts for payments received for Online Consultation Services.
6.4. Additional services provided (Q&A, health tests, etc.) are optional and may be changed or removed at the Company's discretion.
6.5. The Company shall facilitate the use of features, visibility of provider schedules, and secure payments.
6.6. The Company shall provide infrastructure for communication and resolve issues promptly but is not responsible for post-consultation care.
6.7. The Company does not process or store any consultation data.
6.8. The Company may suspend or shut down the application temporarily for maintenance or updates.
6.9. The Company will act promptly on account deletion requests and delete personal data accordingly.
6.10. The Company reserves the right to make decisions regarding application functionality.
6.11. In case of illegal use or violation of the Agreement, the Company may unilaterally terminate the account.
6.12. The Company may transfer its rights or obligations under this Agreement to third parties with notice to the User.
6.13. The Company may disclose data to authorities upon formal legal request.
7. Disclaimer
7.1. The Company is not liable for communication or outcomes between Users and Service Providers. It merely acts as a host and is not responsible for offers, consultations, or user-generated content. It will act upon notifications as required by law.
7.2. The Company is not liable for damages resulting from unauthorized access to or misuse of login credentials.
7.3. The Company is not responsible for damages caused by account transfers or unauthorized access.
7.4. The Company is not responsible for recordings or content shared during consultations.
7.5. Neither party shall be liable for failures caused by force majeure events.
7.6. The Company does not guarantee the accuracy of statements made by Service Providers.
8. Miscellaneous
8.1. The headings in this Agreement are for reference only and do not affect interpretation.
8.2. Users may contact the Company via email at info@healtius.com.
8.3. The invalidity of any clause does not affect the remaining provisions.
8.4. By approving this Agreement, the User acknowledges having read, understood, and accepted its terms.
8.5. This Agreement remains in effect until the User's account is terminated by either the Company or the User.
